TERMS AND CONDITIONS:

Thank you for choosing our web development services! 

Below are the terms and conditions for invoicing which you accept when you send us initial Payment:

Refund Policy: 

You are entitled to get a 100% refund of the upfront payment you made (if any) in the event of:
You are not satisfied with the initial design mockup (first draft) although you can request to make another draft as well.
We didn’t start your project at all or we’re unable to start soon.
We are unable to complete the project as per the project’s specifications & features agreed upon. There should be a properly written document with all the features discussed so if the requirements or features increase after that then this condition will not be applicable.
You want to cancel the project within 12 hours of making payment.
Conditions where you will get partial or no refund:
You have already approved the design mockup then we will refund your 50% amount given to us if you ask within 7 days of starting the project after 7 days you can not apply for the refund.
The project delays are caused by a lack of communication from your end as we won’t entertain or refund any orders if the client stays non-responsive for 30 Days however, the client can send us an email or can call us to hold the project if there are some personal issues.
If Domain & Hosting or other domain-related services was purchased then that amount will be deducted which is $30. As once we or you purchased your Domain Name & Hosting, you are the owner of it and it cannot be “returned” until the duration of the Domain & Hosting term has expired.
No refunds for Installment based projects however you can contact us to pause or cancel your membership on a 1 month’s notice period.
No refunds after the project is completed by our end and delivered to the client.
By having a solid refund policy like this, we are protecting the interest of EVERYONE implicated in the transaction, including you considering you are a client yourself.
We are a community of like-minded people and we all want to make money honestly and for many years to come.
If client Dissapers or is unable to respond the project would be consider delivered after trying to contact them for 7 days and client cant claim a refund

Delivery: 

Nested Kode can give you the final delivery within 2 to 3 business days after completion of Work.

Payment: 

10-25% amount can be paid by the client, if the client cannot pay 25% advance, then the client can have basic sketch with a amount of a surety and afterthat can pay remaining Balance.

Scope of Work: 

The invoice will reflect the scope of work that was agreed upon between the client and the web development team. Any additional work that was not previously agreed upon will require a separate invoice.

Project Timeline: 

The invoice will include the estimated timeline for the project. Any delays due to the client’s failure to provide information or feedback in a timely manner may result in additional charges.
Changes to Scope of Work: If the client requests changes to the scope of work after the invoice has been sent, a revised invoice will be issued reflecting the additional work and changes.

Ownership and License: 

The client will retain ownership of all content and materials provided to the web development team for use in the project. The web development team retains ownership of any software, code, or proprietary tools created for the project. The client is granted a non-exclusive license to use the final product for business purposes.
Warranty and Liability: The web development team warrants that the final product will be free from defects and will function in accordance with the specifications agreed upon. The web development team shall not be liable for any damages, losses, or expenses arising from the client’s use of the final product. In case of script installations any changes in script or errors are not covered by us
Confidentiality: The web development team agrees to keep all client information confidential and will not disclose any information without the client’s prior consent.

Termination: 

Either party may terminate the project at any time by providing written notice. In the event of termination, the client shall pay for all work completed up to the date of termination.if client is not paying us or ghosting our messages we would be waiting for 3 days after that Nestedkode reserves the right to delete the entire project and when he shows up again he has to pay full amount again.

Backup Term: 

we can store the backup of the web for 15 days. If you needed any backup after the timeline or any issue after that time additional charges are applied.

Product Upload: 

For basic or simple e-commerce web NESTED KODE uploads 10 to 15 products only, if the client wants to upload more products, then the client can upload himself.
(Any additional changes in script e.gpre made webs from codecanyon would be charged Seprately and are not included in scope of Work)

Delivery of Web:

 When the full information of the web is delivered to the client, it’s the client’s duty to change their password. In case of a leak of password issue or data craft after delivery of the full task the NESTEDKODE is not responsible for that.As soon as the password is provided to client its his responsibility.Any changes done by client in Website which result in breaking of code or any critical error wont be entertained under maintainence and would be charged Seprately
Additional Requirements: When the clients need any additional requirements then they pay extra charges.


By accepting this invoice, the client agrees to the above terms and conditions. If you have any questions or concerns, please don’t hesitate to contact us.
Incase of any errors or bugs in the code the timeframe may extend and cause a delay upto 20-25% increased time in project timeline or sometimes maybe more if client intends or ask too change something in Mid of Project
